Management of Listing by DesignArcade

In the event of DesignArcade managing the listing (including but not limited to articles, photographs, images, illustrations, and video clips, software and databases) on behalf of the listing company in accordance with the agreement between DesignArcade and the listing company the following conditions shall apply

1)      Any material or content supplied by the listing company through any communication means (including but not limited to phones, sms, emails, couriers) which is required to be listed by the listing company, shall be done by DesignArcade at the sole responsibility of the listing company.

2)      The listing company hence agrees that any material provided to us for listing in DesignArcade Website does not transgress any copyright/intellectual property laws and in case of and legal actions regarding the copyright/intellectual property issues the listing company shall be solely responsible for the same.

3)      DesignArcade reserves the rights of rejecting, modifying or deleting any content ( including but not limited to articles, photographs, images, illustrations, and video clips, software and databases) without any intimation to the listing company at its sole discretion.

Community Guidelines for Discussion Participants & Members
Participants/Members/Website Visitors are responsible for their own communications and the consequences of posting those communications(images, comments, articles, photos etc.). Participants/Members/Website Visitors agree that they will NOT perform/do/take the following actions and if they do they AGREE to take full responsibility of any consequences that might arise and that Design Arcade (Ascension Technologies) will not in any way be liable for the same. :

(a) Use the forums for any purpose in violation of Indian and International laws;

(b) Post material that is copyrighted, unless the user is the copyright owner or has the permission of the copyright owner to post it in accordance with the terms of this agreement.

(c) Post material that infringes on any other intellectual property, privacy or publicity rights of others

(d) Post sexually explicit messages or images or messages that are defamatory, threatening, obscene , harassing or abusive to another participants or any other person or entity;

(e) Post unsolicited advertisements or business solicitations
(f) Don’t upload content that is illegal or prohibited.

If the administrator believes that one or more of these guidelines have been violated by a participant, that person's membership will be promptly terminated without any intimation to the participant and necessary actions will be taken in accordance to the national laws.

No Warranty
DesignArcade does not warrant the accuracy, truthfulness or reliability of any material posted by or endorse any views or opinions expressed by discussion participants. Participants acknowledge that any reliance on content or material posted by other participants will be at their own risk.

Member account, password and security
You will receive a password and account designation upon completing the Design Arcade registration process. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify Design Arcade of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. Use of a login name is not to be confused with impersonating another person. A login name should only be used by its creator. Impersonating is to assume the login name, email address or character of another participant using the discussion board. Impersonating another person is not allowed. Design Arcade cannot and will not be liable for any loss or damage arising from your failure to comply with this Section.

Screening and Monitoring
DesignArcade does not screen communications in advance and is not responsible for monitoring or screening material posted by participants/members/web visitors. Although DesignArcade may regularly review discussions, chats, postings, transmissions, bulletin boards and the like, Design Arcade is under no obligation to do so and assumes no responsibility or liability arising from the content of any such communications nor for any error, defamation, slander, omission, falsehood, obscenity, pornography, danger, or inaccuracy contained in any information within such locations on the site. The liability will solely lies with the participant/member.


Originality
All information, comments, or opinions posted in the discussion forums must be the original thoughts of the participant. The posting of any information that violates or infringes upon the right of any third party is not allowed. This includes copyright, trademark and proprietary rights. Non-original content may only be posted with the permission and due credit of the third party.

Sharing Information
Posts from participants may contain links to other sites on the Internet not owned by DesignArcade. DesignArcade is not responsible for the content located on any external site whose links are posted by participants on DesignArcade. If you choose to proceed to an external site, you proceed at your own risk. DesignArcade doesn’t represent or endorse the accuracy of any content posted in any discussion.

DesignArcade 's License
Discussion participants grant DesignArcade a perpetual, royalty-free, irrevocable license to use, reproduce, publish, modify, translate, distribute, and display materials posted by participants, alone or as part of other works in any form, media or technology whether now known or hereafter developed, and to sublicense such material through multiple tiers of sub-licensees. Furthermore, DesignArcade is free to use any ideas, concepts, know-how, or techniques contained in any communication participants send to the DesignArcade site for any purpose whatsoever including, but not limited to, developing, manufacturing and marketing products using such information.
